Essential features of the contract
Products at www.bokretakeramia.hu webshop is the subject of a contract between the seller and the buyer. The unique features of the products in the webshop are on the product page. The images shown are illustrations in some places, so the actual color, shape, pattern or accessories of the product do not always match the ones shown on the picture. The purchase price next to the product is always the gross price of the selected product. The price of the product includes the value added tax according to the applicable legislation.

The language of the contract is Hungarian. The contract is not a written contract and will not be filed. The contract cannot be retrieved later. The contract does not refer to a code of conduct.

The process of ordering


1. Product Selection
The customer can click on the product name or photo of the selected product to view the product overview. The decorative elements on the product photo (such as green leaves) are not part of the product except where the product specification highlights it separately.

2. Put the product in the basket
After the product number and, where possible, the color of the product are given, the buyer can place the product in a virtual basket by clicking on the basket button. There is no payment obligation for the product in the basket. If you want to add more products to your basket, put the product or products you want to purchase in the basket. The basket automatically calculates the total amount of the order.

3. View Basket Contents
When ordering, it is possible to view or modify the contents of the basket. If the basket does not contain the quantity you want to order, enter the quantity you want to order in the input field in the QUANTITY column and press the UPDATE BASKET button. If you want to delete the products in the basket, press the trash button in the DELETE column. If you do not want to buy more products and checked everything, including price and quantity, click the CASH button.

4. Registration
In the webshop you can register or buy without registration. With registration, you can shop faster in the webshop the next time, keep up-to-date with your order status and track your previous orders. If you register, you can move on to the ordering process after entering the information you need to register. If you are already a registered customer, you can proceed with the information you need to log in. If you choose to make purchases without registration, you can proceed to the order process after entering your billing and shipping information.

5. Provide purchasing, shipping, and payment details
When ordering, you need to provide shipping information (name, address, email address, phone number). The webshop system stores transport data automatically as billing information. If billing and shipping information are different, the sign must be removed next to the BILLING INFORMATION IS THE SAME AS SHIPPING INFORMATION section and BILLING INFORMATION must be provided. When you enter your order details, you can select a method for picking up and for payment for the product. You can enter any information about your order in the NOTE text box.

6. Check your order
Before submitting your order, you can check the price of the product you want to buy, shipping costs, shipping and billing information once more. If you encounter an error, press the BACK button and make any necessary changes.

7. Finalize the order
If you find everything in order when checking your order, send your order by pressing the ORDER button. By submitting the order, you accept the Terms and Conditions of the Webshop and acknowledge that the order is subject to payment.

When someone places an order in the webshop, the Customer may be considered as a tenderer, so the conclusion of the contract between the Buyer and the Seller is established when the Seller accepts the offer made through the webshop. The automatic order confirmation email sent by the webshop is not considered as acceptance of the offer.

Prices
Our prices are the list prices at the time of order, which are next to the products in the webshop. Prices are gross prices, including VAT. Prices do not include shipping costs. Shipping costs can be seen before finalizing order, or in Frequently Asked Questions.

Procedure for the wrong price
In spite of all our efforts, the product may be at the wrong price in the webshop. We cannot accept and deliver the order at the wrong price. If the product is ordered at the wrong price, no contract is concluded between the seller and the buyer. In case of ordering at the wrong price, our system can send an automatic confirmation e-mail, however it cannot be considered as acceptance of the order. In such a case, we will immediately inform the Buyer of the new data after recognizing or modifying the error. The Buyer can then confirm the order once more or it is possible for any party to withdraw from the contract.

Processing your order
Orders are processed on business days until 15:00. Of course, the Customer may place his or her order outside of this time period, which will be processed on the next business day.

Order fulfillment for domestic orders
The ordered products are shipped within 8-14 business days. If the Seller cannot deliver the product specified in the contract because it is unavailable, the Seller shall immediately inform the Buyer of this fact, and refund the amount already paid, as soon as possible, but not later than thirty days.

Order fulfillment for foreign order
The ordered products are delivered within 1-4 weeks in Europe and up to 2-6 weeks in other countries. If the Seller cannot deliver the product specified in the contract because it is unavailable, the Seller shall immediately inform the Buyer of this fact, and refund the amount already paid, as soon as possible, but not later than thirty days.

Possibility to correct data entry errors
At the time of ordering, the Customer shall have the opportunity to modify or delete the entered information. If you have already moved on from the data sheet you want to modify but have not yet finalized your order, it is advisable to click on the back button of the browser until the page you want to view appears, where you can make the changes. If you'd like to edit the data after you submit your order, you can indicate your intention to make changes to one of the contacts listed above. By finalizing the order, you acknowledge that the Seller shall not be held liable for any damage caused by the Customer's incorrect entry of data or incorrect data. A full or inaccurate e-mail address during ordering may result in a lack of confirmation, which may prevent the contract from being created.

Confirmation
We will send you a confirmation for each order via e-mail. This means that after the order has been sent, you will receive an automatic e-mail on receipt of the order and later on, on the expected delivery date or on the acceptance of the order. If you want to place an order by phone, call the webshop's phone number. The Seller is obliged to confirm the order to the Buyer without delay - within 48 hours. Should this not be the case, the Buyer will not be bound by the order and will not be obliged to take over the delivered product.
In the case of a personal pick-up method, please always wait for the notification about the possibility of personal pick-up by e-mail or telephone.


Payment methods

  • Pay on collect: If you would like to pay the value of the ordered product upon receipt of the product, please select the Pay on collect payment method.
  • Bank Transfer: If you want to pay the price of the ordered product by bank transfer, choose Bank Transfer Payment. In the comment box, enter your name and order ID. The details of the transfer (Beneficiary's name, Beneficiary's bank account number, Beneficiary's bank) can be found in the data of the webshop company.
  • Cash Payment: In the case of personal pick-up, we offer cash and credit card payments.
  • Barion Payment: If you want to settle the value of the ordered product with the Barion system, choose the method of Payment with Barion. If you choose to pay with Barion, you can pay with your credit card or prepaid balance in our online store conveniently and securely. Registration is not required for credit card payment, you need to enter your credit card number, expiration date and CVC code on the back and a working email address. However, if you sign up, you will never have to type in the card number at any one Barion acceptance point, your email address and password will be enough to pay. This is not only convenient, but it also increases security! You may use a Mastercard or Maestro credit card, Visa or Electron credit card and Amex credit card for payment. If you do not have a bank card for payment, you can use the prepaid Barion balance that you can transfer by bank transfer or cash deposit, with which your friends and colleges can send you money. In this case, you can pay by entering your email address and password. Registration and the Barion mobile app, as well as receiving and sending money are free.

Product verification
The customer must always check the integrity of the goods upon receipt. If the check is performed in the presence of a courier and the product is damaged, do not take the product, prepare a report. Quantitative Complaint or Damage Complaint can be fully accepted if a video is taken of the opening of the package, which in good quality clearly shows that the package was unopened at the start of the recording (so all sides of the package is recorded) and the unedited recording shows the whole package.

Shipping Methods

  • Personal pick-up: In case of personal pick-up, you can receive the ordered product in the shop (1052 Budapest, Károly körút). Personal pick-up is free of charge.
  • Home delivery: If you choose this delivery method, the courier will deliver your package to your home. Delivery is between 8 am and 5 pm on business days. If the first delivery fails, the courier leaves a notification in the mailbox. You can contact the courier service at the telephone number on the notice and specify another delivery time. The package search feature is available online at any time of the day. The shipping fee is 2295 HUF in Hungary and 2950 Ft in the case of payment on collect delivery. Some a few examples of shipping costs are given in the table below. Prices may vary depending on the size and weight of the package! For detailed information or the current price of further countries, please contact our colleagues!

In the case of shipping outside of the European Union, other charges (such as customs duties) shall be borne by the Buyer.

Withdrawal from shipment
If the ordered product is not at the disposal of the seller, the seller reserves the right to refuse the confirmed order in whole or in part. Partial execution may take place after consultation with the customer. If the seller is unable to fulfill his contractual obligations, he must inform the customer as soon as possible.

The webshop does not sign a contract with minors. Buyer declares that he or she is of age by accepting the terms of the contract.


Description of the right of withdrawal for the Customer:
The customer, by the 45/2014. (II. 26.) Government edict, shall have the right to withdraw from the purchase within 14 days of receipt of the products without justification. In this case, the Seller is obliged to refund the full amount paid by the customer to the customer immediately, but no later than 14 days after the receipt of the customer’s withdrawal statement. The Seller shall reimburse to the customer the full amount paid by the customer in the exercise of the right of withdrawal, including the cost of delivery.

Should the Seller fail to comply with its obligation to disclose the right of withdrawal or cancellation, the withdrawal or notice period shall be extended by 12 months. If the Seller provides the information after the expiry of 14 days from the date of receipt of the product or the conclusion of the contract, but within 12 months, the period for withdrawal or cancellation shall be 14 days from the date of notification.

When several products are sold, if the individual products are shipped at different times, or the product consisting of several lots or pieces, the time of last product delivered may be used by the Customer with the right of withdrawal within 14 days of receipt.

If the customer has made an offer for the conclusion of the contract, the customer has the right to withdraw the offer before concluding the contract, which eliminates the binding nature of the offer covering the conclusion of the contract.

The customer shall exercise his right of withdrawal between the date of conclusion of the contract and the date of receipt of the product.
The customer shall bear the burden of proof that the right of withdrawal is in accordance with Article 45/2014. (II. 26.) Government edict as defined in Section 20.


Obligations of the enterprise in case of withdrawal or termination
If the customer withdraws the order on the basis of 45/2014. (II.26.) Government edict 22§, the company shall reimburse the total amount paid by the customer, including any other costs incurred in connection with all costs of the order, as soon as possible, but no later than fourteen days after becoming aware of the cancellation. However, the Seller shall not be obliged to reimburse the customer for any additional costs resulting from the choice of mode of transport other than the cheapest way of transport offered by the Seller.
In case of cancellation based on 45/2014. (II.26.) Government edict 22§, the Seller shall reimburse the amount returned to the customer in the same manner as the payment method used by the customer. Subject to the express consent of the customer, the Seller may use other means of payment for the refund, but the customer shall not be charged any additional fees.

If the customer expressly chooses a mode of transport other than the least expensive conventional mode of transport, the Seller is not obliged to reimburse the resulting additional costs.

The Seller shall have the right to withhold the full amount paid by the customer until the product has been returned or the customer has not proved to the satisfaction of being returned. The Seller is not entitled to the retention if he has undertaken to return the product himself.

In addition to the consideration for the company’s compliance of its principal contractual obligation, a further contractual financial entitlement shall not be considered as expressly accepted by the customer if the company uses a default option (a pre-completed field) that the customer has made to avoid paying the excess amount. In this case, the company is obliged to reimburse the amount paid to the customer.

Obligations of the customer in case of cancellation or termination
If the customer wishes to exercise the right of withdrawal without justification, he or she must send the cancellation declaration containing his or her intention to withdraw within 14 days of receipt of the product to one of the following contacts:

If the customer is in compliance with 45/2014. (II. 26.) Government edict 22. § right of withdrawal, he or she is obliged to return the product immediately, but no later than within fourteen days of the notice of withdrawal, to the address indicated by the Seller or to the person authorized by the company or the enterprise to take over the product. The deadline is deemed to be met if the customer sends the product before the deadline expires.

The customer shall bear the costs of returning the goods due to the exercise of the right of withdrawal, unless the Seller undertakes to bear this cost. In addition, the customer is not charged any other costs. In the case of our webshop, the Seller does not take over the cost of returning the goods, so it is the customer’s responsibility.

If the product has been shipped to the customer at the same time as the off-premises contract, the Seller will return the product at its own expense if it cannot be returned as a postal item by its nature.

The customer shall only be liable for any depreciation resulting from use beyond the uses necessary to determine the nature, characteristics and functioning of the product. The customer is not responsible for the depreciation if the company does not inform the customer of the right of withdrawal.


Exceptions to the right of withdrawal to the customer
by the 45/2014. (II. 26.) Government edict 29 § (1), the customer may not exercise his right of withdrawal in the following case:
- In the case of a non-prefabricated product which has been produced at the customer’s request or at his or her express request, or in the case of a product which is clearly customized to the customer;
- perishable or short-term preservation;
- In the case of a sealed product which cannot be returned for health or hygiene reasons after it has been opened after delivery;
- For a product which by its nature is inseparably linked to another product after delivery;


Accessori warranty
In which case do you have the right to warranty?
If the Seller's defective fulfilment, you may enforce a claim against the Seller in accordance with the rules of the Civil Code.
What rights do you have on your warranty claim?
You may choose, at your option, to claim the following warranty claims: You may request repair or replacement unless the fulfillment of your choice is impossible or would involve a disproportionate additional cost for the business to meet your other needs. If you did not request or have been asked for repair or replacement, you may request a proportionate delivery of the consideration, or you may repair the defect at the expense of the company, or, in the end, terminate the contract. You can also switch from your chosen warranty right to another, but you will bear the cost of the transition, unless it was justified or the business gave cause.
What is the deadline for enforcing your warranty claim?
You must disclose the error immediately after discovering it, but not later than two months of the discovery. At the same time, we would like to draw your attention to the fact that you may not enforce your warranty rights beyond the two-year limitation period after the fulfilment of the contract. In the case of used items, this deadline is up to one year.
To whom can you claim your warranty claim?
You can enforce your warranty claims against the business.
What other conditions are there for enforcing your warranty rights?
Within six months of delivery, the assertion of your warranty claim is not subject to the condition of failure, unless you certify that the product or service was provided by the Seller. However, after six months of completion, you are already required to prove that the error you have detected was already at the time of completion.

Product warranty
In which cases can you exercise your product warranty rights?
In the case of a defective item (product), the customer may decide whether the product has been previously described; you have a right of warranty; can claim product warranty claims.
What are your rights under your product warranty claim?
As a product warranty claim, you may only request the repair or replacement of the defective product.
In which case is the product considered defective?
The product is defective if it does not meet the quality requirements of the product when it is placed on the market, or if it does not have the properties given in the manufacturer's description.
What is the deadline for enforcing your product warranty claim?
You may enforce your product warranty claim within two years of the product being marketed by the manufacturer. At the end of this period, you will lose your entitlement.
To whom and under what other conditions can you claim your product warranty claim?
You may only exercise your product warranty claim against the manufacturer or distributor of the product. You must prove that the product is defective when claiming product warranty.
In what case is the manufacturer (distributor) exempted from the product warranty obligation?
The manufacturer (distributor) is only exempted from product liability if he can prove that:
- the product was not manufactured or marketed in the course of its business, or
- the error was not recognizable at the time of placing on the market, according to the state of the art and science
- a product defect results from the application of legislation or mandatory regulatory requirements.
The manufacturer (distributor) has enough reason to prove the exemption.
Please note that due to the same error, you may not enforce warranty claims and product warranty claims simultaneously. However, in the event of effective enforcement of your product warranty claim, you may enforce the warranty claim for the replaced product or repaired part against the manufacturer.

Description of complaint handling options
Complaints about the activity of the webshop or the product marketed by the webshop can be submitted to the webshop operator via email and mail. If the webshop also has a retail store, we can communicate your complaint to the seller personally. The seller must respond to the complaint received by e-mail or by post in writing and send it to the customer within 25 days.
If the seller does not consider the complaint formulated by the buyer to be justified, he or she must justify it and send it to the buyer in writing, and must provide written information to the customer, according to the nature of his or her complaint, which complaint handling options are available. The seller is obliged to provide the seat, telephone contact details, internet access and mailing address of the competent conciliation body of the customer”s domicile or place of residence.
The seller must keep a record of the complaint and a copy of the response for five years.

Consumer protection Authority
If customer’s complaint is denied, he or she may submit his or her customer complaints to the consumer protection staff of the nearest competent district office in their place of residence. Once the complaint has been settled, an official procedure is carried out, if necessary. Conciliator Body
If the customer's consumer complaint is rejected, you are entitled to lodge a consumer complaint with us, which you may submit to the relevant Conciliation Body of your domicile or place of residence. The proceedings of the conciliation body shall commence at the request of the customer. It is a condition of the consumer conciliation body that the customer attempts to settle the dispute directly with the business. Direct dispute resolution can be done personally at the service desk of the service provider, by phone or by e-mail. A further requirement is that the application for a panel procedure to be submitted to the Chairman of the Board includes:
the name, place of residence of the customer;
the name and registered office or place of business in which the customer is in dispute;
if the customer wishes to lodge an application with the body whose jurisdiction is adapted to the place of performance of the contract, the customer must indicate the place of performance of the contract;
the customer’s position on the existing dispute, as well as the facts and evidence supporting his own position;
a statement by the customer stating that he or she has attempted to settle the dispute directly with the enterprise;
the customer should also declare that he or she has not initiated proceedings in the case of another conciliation body, did not initiate mediation proceedings or civil proceedings;
it must include what you ask for, what decision to take from the body.

Court proceedings
If the customer does not turn to a conciliation body or the procedure has failed, the customer has the right to apply to a court to settle the dispute.
The lawsuit must be instituted by means of a claim form, containing the following information:
the court seised;
names, domicile and litigation of the parties and representatives of the parties;
the right to be enforced by presenting the facts on which it is based and its evidence;
the data from which the jurisdiction and jurisdiction of the court can be established;
a firm request for a court decision (claim).
The application must be accompanied by the document or a copy of the document to which it refers as evidence.

Online dispute resolution platform
The European Commission has set up a website for customers to register, allowing them to settle disputes over online shopping by filling in an application, avoiding court proceedings. Thus customers can enforce their rights without, for example, distance preventing them from doing so.
